PUBLIC OFFER (Публичная оферта)

The legally binding public offer of TunePulse is provided in Russian and is available in full in the Russian version of this document. The Russian text is the authoritative version and prevails in any dispute. This English note is an informational summary only and has no legal force.

Summary of the preamble This public offer is addressed to adult, legally capable individuals under Article 435 and part 2 of Article 437 of the Civil Code of the Russian Federation, granting rights to use the service's functionality within the limits set out in the offer. Details of the Licensor are given in Section 10. Acceptance of the offer occurs upon the start of using the service.

The offer covers, among other things: the subject of the licence (a simple, non-exclusive licence, provided "as is"); the rights granted to the Licensee over generated content (lyrics and AI-generated audio, with personal non-commercial use of the audio); the parties' rights, duties and liability; fees and payment (full prepayment); dispute resolution under the law of the Russian Federation; personal data processing; a legal disclaimer that AI-generated content is not connected to any real artists, rightholders or labels; the procedure for rightholder claims; and the Licensor's details.

Limitation of liability The Licensor is not responsible for the actions or omissions of users, nor for content that users create, publish or share. The Licensor does not and objectively cannot control the creativity of third parties — the ideas users submit, the works they generate or the materials they post — and does not pre-moderate user content; responsibility for such content lies with the user who created it. The service is provided "as is" and "as available", without warranties of uninterrupted or error-free operation. The Licensor is not liable for indirect damages or lost profits, nor for failures of third-party services (Telegram, payment providers, AI providers, hosting) or force majeure. The Licensor's aggregate liability is limited to the fees actually paid by the Licensee during the last 3 months. Users interact with each other at their own risk and resolve disputes between themselves without the Licensor's involvement.
